These terms govern the purchase of goods and gift vouchers, the booking of tandem flights and enrolment in courses via the website www.ifly.si. They are written to be understandable; where they refer to the law, this does not limit the rights granted to the consumer by applicable legislation.

1. Details of FSP and definitions

The website www.ifly.si is operated by FSP, d.o.o., Vesca 6a, 1217 Vodice, registration number 3381137000, VAT ID SI88201856, email info@ifly.si, phone 031 305 048 (hereinafter: FSP or the provider). FSP is the seller of goods, the contractual provider of services and the organiser of bookings that the user makes via the website.

Definitions

  • User — any person who places an order, booking or enrolment on the website. A consumer is a user who does so for purposes outside their trade, business or profession.
  • Actual operator — a subcontractor who physically carries out passenger air transport by tandem paraglider and holds, on the day of the flight, a valid permit from the Civil Aviation Agency of the Republic of Slovenia (CAA) for commercial passenger transport.
  • Pilot — a natural person holding a valid T/JP authorisation and the other required checks and training, who carries out the flight within the actual operator.
  • Course provider — FSP or a subcontractor who actually delivers all or part of the training. Where regulations for a particular form of training require an authorisation, it is delivered only by a person holding a valid appropriate authorisation.
  • Gift voucher — a document with a code with which the holder redeems the stated service or value within the validity period.
  • Ticket — confirmation of the passenger air transport contract, which the user receives on a durable medium (email with PDF) before the tandem flight.
  • Durable medium — email, PDF or another form that allows the user to store the information and view it unchanged at a later time.

2. Scope and subcontractors

These Terms apply to all purchases, bookings and enrolments made via www.ifly.si and to gift vouchers issued on that basis. In addition to the general provisions, special terms apply to each type of offer in sections 9 (tandem flights), 10 (courses) and 11 (gift vouchers). The special terms are available to the user via the link shown when confirming the Terms before payment.

FSP is the contractual provider and organiser. It may entrust the delivery of the service to subcontractors: tandem flights are carried out by independent actual operators holding a valid CAA permit, and courses by FSP or qualified subcontractors. FSP is not the actual operator of a tandem flight when it does not carry out the flight as the holder of the CAA permit.

The use of a subcontractor in no way reduces the user's mandatory consumer rights against FSP. The user's contractual partner for the order, payment, notifications, cancellations and refunds remains FSP; the roles and responsibilities of the actual operator are described in Sections 9 and 13.

3. Order, conclusion of the contract and prices

The user selects goods or a service, enters the required details and, before the binding step, sees the selected service or items and the final price including VAT. Before submitting, the user confirms having read these Terms and the Privacy Policy (both linked next to the checkbox); the special terms for tandem flights, courses and gift vouchers are in sections 9, 10 and 11. Prices include VAT; any delivery costs are shown before payment.

The button that triggers payment or a binding order is labelled "Order with obligation to pay" or "Pay now". By clicking it, the user confirms that they have read these terms and the privacy policy and that they are placing an order with an obligation to pay.

The contract is concluded when FSP receives payment confirmation via the Stripe payment service; when paying with a gift voucher or coupon, it is concluded when the booking or enrolment is submitted. On conclusion, FSP sends the user an email confirmation with a summary of the contract and an unalterable copy of the terms in force at the time of the order. FSP stores the version of the accepted terms, the time of acceptance and the order identifier.

All prices are in euros and include VAT. The price valid at the time the order is placed applies. If it turns out that the published price was obviously wrong due to an error, FSP informs the user and allows them to withdraw from the order free of charge or to confirm the order at the correct price.

FSP does not process orders with obviously incorrect details. FSP may call the user on the phone number provided to verify the details.

4. Payment and invoice

Online payments are processed by the Stripe payment service. The user enters card details in Stripe's secure form; FSP does not receive or store card details. The following are available:

  • debit and credit cards (Visa, Mastercard, American Express),
  • Apple Pay, Google Pay,
  • PayPal,
  • gift voucher or coupon (when booking a tandem flight or enrolling in a course).

Payment by pro-forma invoice to a bank account is possible on request (particularly for business customers) by arrangement via info@ifly.si. Transaction account:

FSP issues the invoice electronically and sends it to the email address given with the order. Registered users can also access their orders in their user account.

5. Physical goods, delivery and damage

The user selects the delivery method during the purchase process. Collection in person is free of charge. For postal delivery, the delivery cost is shown before the order is placed and is included in the final price.

FSP normally dispatches goods in stock within one working day of payment confirmation. If the goods are not in stock, FSP informs the user by email of the expected delivery time; if the time does not suit the user, they may withdraw from the order free of charge.

Damaged shipments

If a shipment is damaged, its contents are missing or it shows signs of having been opened, the buyer informs FSP, d.o.o. at info@ifly.si as soon as possible, attaches photographs of the packaging and contents and keeps the packaging until the procedure is completed. FSP conducts the claims procedure with the carrier. The buyer cooperates reasonably in preparing a report or presenting the shipment where necessary.

6. Withdrawal from the contract for physical goods

When purchasing goods online, the consumer has the right to withdraw from the contract within 14 days of receiving the goods without giving a reason (Consumer Protection Act, ZVPot-1). Withdrawal is communicated to FSP by email at info@ifly.si or by post to the company's registered office; the form below may be used.

  • The goods are returned no later than 14 days after the notice of withdrawal.
  • The consumer may examine the goods to the extent necessary to establish their nature, characteristics and functioning; they are liable only for a reduction in value resulting from handling beyond such examination.
  • FSP refunds all payments received, including standard delivery costs, no later than 14 days after receiving the notice of withdrawal, using the same means of payment that was used for the payment. FSP may withhold the refund until it has received the returned goods or proof that the goods have been dispatched.
  • The direct costs of returning the goods are borne by the consumer, as they are informed of this by these terms before the purchase.

Exceptions

By law, the right of withdrawal does not apply to goods made to the consumer's precise specifications or clearly personalised, to sealed goods which are not suitable for return for health or hygiene reasons if the seal has been removed after delivery, and to other statutory exceptions. A gift voucher with the recipient's name entered is not custom-made goods; Section 11 applies to it.

7. Non-conformity of goods

The seller is liable for any non-conformity of the goods that existed at the time of delivery and becomes apparent within two years of delivery. The consumer informs the seller of the non-conformity found within two months of discovering it and allows the seller to examine the goods. The consumer first requests that conformity be restored free of charge by repair or replacement, unless the chosen remedy is impossible or would cause disproportionate costs. Conformity must as a rule be restored within 30 days at most; under statutory conditions the period may be extended by no more than 15 days, of which the consumer must be informed in good time. A proportionate price reduction or withdrawal from the contract is possible under the conditions of ZVPot-1. If the existence of the non-conformity is disputed, FSP responds to the consumer in writing within eight days of receiving the claim.

The user reports a non-conformity to info@ifly.si or by post to the registered office of FSP. These terms in no way limit the consumer's statutory rights.

8. Warranty

  • The mandatory guarantee of faultless operation applies only to those categories of goods for which it is prescribed by regulation. It does not apply to all products.
  • A voluntary (commercial) guarantee from the manufacturer or seller applies under the conditions stated in the guarantee certificate; its scope and duration are stated there or on the product page.
  • Under the mandatory guarantee, the period for remedying a defect is 30 days from receipt of the claim; under statutory conditions it may be extended by no more than 15 days, of which the consumer is informed.
  • The guarantee does not affect the consumer's rights in respect of non-conformity of goods (Section 7).

If no guarantee information is given for a product, the user may contact FSP before the purchase and will be given up-to-date information.

9. Special terms for tandem flights

Who sells and who flies

Online sales and booking organisation are handled by FSP, d.o.o. The flight is carried out by one of the independent operators holding a valid CAA permit for commercial passenger transport by tandem paraglider. The specific operator is determined depending on the date, location, weather conditions and availability. You will receive its company or personal name, permit details and passenger insurance details in the confirmation or ticket before the flight.

A tandem flight is passenger air transport. The user concludes the transport contract with FSP as the contractual provider; the transport is performed by the actual operator. Where the operator is already known before payment, it is shown before payment; otherwise the user clearly sees before placing the order that it will be determined later.

Ticket

Once the actual operator has been assigned, FSP emails the user a ticket in PDF form. The ticket contains at least: a unique number, the passenger's name, the contractual provider (FSP), the company name and address of the actual operator, the CAA permit details and its validity, the pilot's name (if finally determined), the date or agreed time frame, the take-off site and the agreed service, the price and the payment method and status or the voucher used, the type of passenger insurance and the amount of cover, the contact for changes and cancellations, the version of the terms in force at the time of the order, the date of issue and the revision number.

If the operator is replaced after the ticket has already been sent, the user immediately receives a new version of the ticket. Replacement is permitted only with another operator that meets all the same mandatory conditions on the day of the flight. If, as a result of the replacement, the essential agreed characteristics of the service can no longer be ensured, the user may reschedule free of charge or request a refund.

Passenger requirements

  • The maximum permitted passenger weight is 120 kg. When booking, the passenger states their true weight; a materially incorrect statement may prevent the flight from being carried out safely.
  • Passengers under 18 need the written consent of a parent or guardian, which must be provided before the flight. When booking, you provide the name and contact details of the parent or guardian.
  • If there is a medical or other circumstance that could affect the safe conduct of the flight, please call us before the flight. Do not enter details in the general notes. The final assessment of safe conduct is made by the pilot.

Safety and refusal to fly

The final decision on the safe conduct of the flight is made by the pilot or the actual operator. The flight is not carried out if weather, medical, behavioural, technical or other circumstances do not, in the pilot's professional judgement, allow a safe flight. The passenger must follow the pilot's instructions and must not be under the influence of alcohol, illegal drugs or other psychoactive substances.

Cancellation and rescheduling of a tandem flight

  • Cancellation more than 7 days before the confirmed date: refund of the full purchase price.
  • Cancellation 7 days or less before the confirmed date: no monetary refund, but one free rescheduling by arrangement.
  • No-show without cancellation: no refund and no free rescheduling.
  • Cancellation by FSP or the actual operator due to weather or another objective circumstance: free rescheduling or refund of the full purchase price, at the user's choice.
  • The period is calculated from the confirmed time of the date, not from the originally proposed date.
  • When paid with a gift voucher, a justified cancellation reinstates the voucher's credit and validity.

Passenger air transport is excluded from most of the ZVPot-1 rules on distance contracts, so a 14-day withdrawal without giving a reason is not a general statutory right for a specific tandem flight already purchased. The cancellation policy above is a voluntary arrangement by FSP that gives the user clear rights on cancellation. For an unused gift voucher, the 14-day return option in Section 11 applies.

10. Special terms for courses

The contractual provider and organiser of the course is FSP, d.o.o. An individual course or its content may be delivered by FSP or by a qualified subcontractor. The participant is informed of the specific provider or instructor before delivery begins. Where training regulations require a specific authorisation, the training is delivered only by a person holding a valid appropriate authorisation.

In the enrolment confirmation the user receives the enrolment reference, the course, the date (or a note that the date will be agreed later), the price and the payment method; a copy of these Terms is attached to the confirmation e-mail. The participant is informed of the specific provider or instructor before training begins. Equipment hire is not included in the price unless expressly stated for the course; completing a course does not automatically confer a licence or authorisation.

Courses for obtaining authorisations (for example the tandem pilot course T/JP or the instructor course U/JP) are intended to train and prepare the candidate for the prescribed procedure of the competent authority. Successful completion of the course does not in itself mean the authorisation has been obtained and does not confer the right to carry out commercial flights or conduct official examinations; the candidate must meet all applicable conditions and obtain the authorisation from the competent authority.

Withdrawal and cancellation for courses

  • For a course purchased online without a fixed date, the consumer may withdraw within 14 days of concluding the contract without giving a reason, provided delivery has not yet started. FSP refunds the payment within 14 days of receiving the notice.
  • If the user wishes to start the course before the end of the 14-day period, they separately and expressly confirm a request for an early start before payment. In that case, on withdrawal they pay a proportionate part of the service already provided; once the service has been fully performed, the right of withdrawal ceases.
  • For a course that is a leisure service on a specific date or within a specific period, where the date is clearly shown to the user before payment, the right of withdrawal under ZVPot-1 (Article 135) does not apply; the cancellation policy below applies instead.
  • Cancellation more than 7 days before the confirmed start: refund of the full purchase price. Cancellation 7 days or less before the start: no refund, one free rescheduling by arrangement. No-show without cancellation: no refund.
  • If the date is cancelled by FSP or the provider (weather, instructor availability or another objective circumstance), the user may choose a replacement date or a refund of a proportionate part of the purchase price for the part not delivered.

Course delivery depends on the weather; dates may be rescheduled. Equipment hire is not included in the price unless expressly stated for the individual course.

11. Gift vouchers – 24 months

The gift voucher is valid for 24 months from the date of purchase. The exact expiry date is stated on the voucher.
  • The voucher is considered redeemed in time if the holder submits a booking or date request before the expiry date. Due to the weather or availability, the service may take place on a later confirmed date.
  • If an already confirmed date is cancelled by FSP or the actual operator due to the weather or another circumstance not attributable to the holder, the voucher is not forfeited. A replacement date is possible even if the original expiry date has passed in the meantime.
  • The voucher is transferable, unless expressly and justifiably stated otherwise on the product due to the nature of the service. The recipient's name is a visual personalisation and does not in itself prevent transfer.
  • A voucher for a specific service (for example a tandem flight) covers that service during the validity period without any surcharge due to a later change in the regular price. A value voucher covers the face value; the user pays the difference up to the price of the chosen service.
  • If the service can permanently no longer be provided, FSP offers a comparable replacement service or a refund of the unused amount.
  • For an unused voucher, the consumer may withdraw from the contract within 14 days of the online purchase and receive a refund of the purchase price. Entering the recipient's name is not a reason for losing this right.
  • After the 24 months have expired there is no automatic refund, except where mandatory regulations require it or the service could not be provided for a reason on the side of FSP or the operator.

12. Cancellations, rescheduling and weather

The user communicates a cancellation or rescheduling by email to info@ifly.si or by phone on 031 305 048. Periods are calculated from the confirmed time of the date.

We distinguish two situations:

  • If the flight or course is not safe or feasible due to the weather, a technical issue, the operator's unavailability or another circumstance not attributable to the user, the user is entitled to free rescheduling or a full refund.
  • If the service is refused because the passenger is under the influence of psychoactive substances, knowingly disregards instructions, states a materially incorrect weight or, despite clear prior instructions, does not meet the agreed conditions, this is treated as a no-show or cancellation on the passenger's side. This sanction does not apply in circumstances that the passenger could not reasonably foresee or for which they are not at fault.

FSP makes refunds using the same means of payment that was used for the payment, no later than 14 days from the day on which entitlement to the refund is established. When paid with a gift voucher, the voucher is reinstated.

13. Liability and safety

FSP performs its contractual obligations with due care and may use vetted subcontractors for performance. The actual operator and the pilot are responsible for the safe operational conduct of the flight in accordance with aviation regulations, the permit, qualifications, equipment limitations and professional judgement. The passenger must follow all safety instructions and, before the flight, provide true information necessary for safe conduct. Nothing in these terms excludes or limits liability or rights that may not be excluded or limited under mandatory regulations.

FSP endeavours to keep the information on the website accurate. If a product's characteristics, delivery time or price change in such a way that the information could not be corrected in time, FSP informs the user and allows them to withdraw from the order or exchange the product. 14. Complaints and out-of-court dispute resolution

A consumer may send a complaint to info@ifly.si or to the business address of FSP, d.o.o. FSP endeavours to respond without undue delay. FSP, d.o.o. does not recognise any provider of out-of-court consumer dispute resolution as competent to resolve a consumer dispute, unless the company subsequently publishes otherwise. If the complaint is not upheld, FSP provides the consumer with reasons in its response, together with the information required by the applicable legislation on out-of-court resolution of consumer disputes (IRPS).

Supervision of the implementation of the Consumer Protection Act (ZVPot-1) and the Electronic Commerce Market Act (ZEPT) is carried out by the Market Inspectorate of the Republic of Slovenia, Dunajska cesta 160, 1000 Ljubljana. 15. Governing law, amendments and version archive

The relationship between FSP and the user is governed by Slovenian law, in particular the Consumer Protection Act (ZVPot-1), the Obligations Code (OZ), for passenger air transport the Act on Obligations and Property Rights in Aviation (ZOSRL), the Electronic Commerce Market Act (ZEPT), the Personal Data Protection Act (ZVOP-2), the General Data Protection Regulation (GDPR) and, regarding cookies, the Electronic Communications Act (ZEKom-2).

The parties will first try to resolve disputes amicably. For consumer disputes, the court of the consumer's habitual residence in the Republic of Slovenia has jurisdiction.

FSP may amend these terms. The new version applies from the day of publication to orders placed after that day. Contracts already concluded are governed by the terms in force when the order was placed; an unalterable copy is sent to the user in the confirmation email and is available in the archive.

16. Privacy and cookies

The processing of personal data is governed by a separate Privacy policy, and the use of cookies and consent settings by the Cookies. Data required to conclude and perform the contract is processed on the basis of the contract; consent is requested only for optional purposes.
